UCITA

For once in my life, I am finding myself actually liking UCITA. For those not in the know, it stands for the “Uniform Computer Information Transactions Act”, and was passed by both Virginia and Marlyand. It makes software licenses, even those click-through ones, into valid legally enforceable contracts. This makes my mock trial a lot easier, as I represent the plaintiff in a DMCA circumvention device lawsuit.
I’m glad I picked the plaintiff in this case. It’s too bad for the defendant, though. This mock trial scenario is a little bit one-sided. It might be a bit more equal if both sides didn’t know a lot about copyright law and the DMCA in specific, but I already knew a good deal and my opponents don’t seem to have known anything prior to getting their scenario.
I feel like a king.
